Box 576\nHouston, TX 77001\nDear Mr. Redweik:\nWe are in receipt of your letter dated March 17, 1997,\nrequesting clarification of DOT jurisdiction over Shell\npipeline facilities transporting non-HVI through low stress\nlines in Cook Inlet, Alaska.\nUnder 49 C.F.R. 195.3 (a) \"Except as provided in paragraph (b)\nof this section, this part applies to pipeline facilities and\nthe transportation of hazardous liquids or carbon dioxide\nassociated with those facilities in or affecting interstate\noI\nforeign commerce, including pipeline facilities on the Outer\nContinental Shelf.\n(b) This part does not apply to\n(1)\nTransportation of a hazardous liquid that is\ntransported in a gaseous state;\n(2)\nTransportation of a hazardous liquid through a\npipeline by gravity;\n(3)\nTransportation of non-HVL through low-stress\npipelines, except for any pipeline or pipeline\nsegment that is located\n(i)\nIn an onshore area other than a rural area;\n(ii)\nOffshore; or\n(iii)\nIn a waterway that is navigable in fact and\ncurrently used for commercial navigation;\n(4)\nTransportation of petroleum in onshore gathering\nlines in rural areas except gathering lines in the\ninlets of the Gulf of Mexico subject to $195.413.\"\nThe lines in Cook Inlet are offshore, conducting\ntransportation of non-HVL through low-stress pipelines and in\na waterway that is navigable, in fact, and currently used for\n\n<<<PAGE 2>>>\n\nCook Inlet waters are considered offshore as they are in\ndirect contact with the open sea and not categorized as\n\"inland waters\". Inland waters are specifically established\nby the U.S. Coast Guard under 33 CFR 80.01. Under this Coast\nGuard regulation, none of the sounds, bays, harbors, or\ninlets of Alaska are considered to be inland waters.\nIf you have any further questions, please contact L.E.
