(Magellan) wrote to the Pipeline and\nHazardous Materials Safety Administration (PHMSA) requesting a special permit to waive\ncompliance with the pipeline safety regulations in 49 Code of Federal Regulations (CFR)\n195.432 that require internal inspection intervals for in-service breakout tanks. Magellan 's\nspecial permit request asks PHMSA to allow extended inspection intervals of 49 CFR 195.432\nfor Magellan ' s existing atmospheric aboveground breakout storage tanks (breakout storage tanks\nor tanks).\nPHMSA is granting this special permit (enclosed) to Magellan to allow extended inspection\nintervals for Magellan' s existing breakout storage tanks as listed in Appendices A and B of the\nspecial permit. This special permit provides relief from the Federal pipeline safety regulations\nfor Magellan 's existing breakout storage tanks, and requires Magellan to comply with certain\nconditions and limitations designed to maintain pipeline safety where the tanks inspection\nintervals have been extended.\nThe Magellan existing atmospheric aboveground breakout storage tanks and associated facilities\ninclude 493 breakout storage tanks at 81locations in 14 states. The breakout storage tank\nfacilities are in industrial properties and consist of storage tanks, buildings, pump stations,\nvalves, facility pipe, roads, and other aboveground appurtenances. This special permit requires Magellan\nto implement inspection intervals based on the evaluation of an established minimum safe floor\nthickness, previous inspection results, corrosion rates, and defined likelihood and consequence\nfactors for existing atmospheric above ground breakout storage tanks, as described in this special\npermit.\n1 Throughout this special permit the usage of \"PHMSA\" or \"PHMSA OPS\" means the U.S. Department of\nTransportation's Pipeline and Hazardous Materials Safety Administration Office of Pipeline Safety.\n2 Magellan Midstream Partners, L.P. and its subsidiaries include the following wholly owned and operated\ncompanies: Magellan Crude Oil Pipeline Company, L.P. (MCOP), Magellan Pipeline Company, L.P. (MPL),\nMagellan Pipelines Holdings, L.P. (MPH), and Magellan Terminals Holdings, L.P. These facilities are industrial properties consisting of storage tanks, buildings, pump\nstations, valves, facility pipe, roads, and other above ground appurtenances.\nBased on the determination in the Special Permit Analysis and Findings (available in the docket)\nthat this special permit, with conditions, will maintain pipeline safety, PHMSA OPS hereby\ngrants special permit PHMSA-2016-0072 as follows:\nI. Special Permit Tanks:\n493 tanks located in the States of Colorado, Connecticut, Illinois, Iowa, Kansas, Minnesota,\nMissouri, Nebraska, North Dakota, Oklahoma, South Dakota, Texas, Wisconsin, and\nWyoming\nOn the condition that Magellan complies with the terms and conditions set forth below, this\nspecial permit waives compliance from 49 CFR 195.432 for the inspection intervals of 493\nexisting atmospheric above ground breakout storage tank as described below and in Appendix A\n-Magellan Breakout Storage Tanks: Location- State, Facility Name, County, and Number of\nTanks and Appendix B- Secondary Dike Containment of this special permit.\n• Special permit tanks- are defined as any of the 493-existing atmospheric above ground\nbreakout storage tank described in Appendix A of this special permit.\nPHMSA hereby grants this special permit for the Magellan special permit tanks based on the\nfindings set forth in the \"Special Permit Analysis and Findings\" and the \"Final Environmental\nAssessment and Findings of No Significant Impact\" documents, which both can be read in their\nentirety in Docket No. PHMSA-2016-0072 in the Federal Docket Management System (FDMS)\nlocated on the internet at www.Regulations.gov.\nII. Conditions:\nPHMSA OPS grants this special permit for the special permit tanks subject to implementation of\nthe following conditions:\nSpecial Permit: PHMSA-2016- 0072 - Magellan Midstream Partners, L.P. Page 2 of22\n\n<<<PAGE 5>>>\n\n1. Internal Inspection Schedule: For the atmospheric above ground breakout storage tanks\n(special permit tanks), Magellan must conduct a transitional staged internal inspection\nschedule as follows:\na. Special Permit Tanks Last Inspected Before 1995: Inspect within 30 years of the\nprevious internal inspection date (25 tanks remain to be inspected as of May 20 17).\nb. Special Permit Tanks Last Inspected Between 1995 and 2009: Inspect within 28\nyears of the previous internal inspection date (333 tanks remain to be inspected as of\nMay 2017).\nc. Special Permit Tanks Last Inspected Between 2010 and 2013: Inspect within 25\nyears of the previous internal inspection date ( 13 5 tanks remain to be inspected as of\nMay 2017).\n2. Special Permit Tank Inspections and Monitoring: Magellan must develop procedures,\nconduct, document, and maintain:\na. Internal inspections of the described existing special permit tanks that are consistent\nwith the special permit and as required by 49 CFR 195.432;3'4\nb. Visual inspections of the special permit tanks and their secondary containment dikes\nare required once per manned shift and at least weekly for unmanned locations.\nMagellan personnel must inspect the tank farm (including tanks and containment) for\nthe integrity of the containment dikes or secondary containment, evidence of product\nreleases, trash and debris, uncontrolled erosion, unusual sounds from operating\nequipment, damage, vibration, misalignment, and security;\n3 If PHMSA adopts a revised edition of API Standard 653 other than the 3rd edition into 49 CFR Part 195, Magellan\nmust notify PHMSA within 60 days of the effective date of the adopted revised standard regarding the option to\ncontinue compliance under this special permit with the existing API Standard 653 3rd edition or comply with the\nupdated edition under 49 CFR Section 195.3. However, if the revised adopted edition of API Standard 653\ncontinues to exclude alternate inspection intervals, the conditions of the special permit will remain in effect for the\ndetermination of inspection intervals.\n4 Industry standards \"incorporated by reference\" are listed in 49 CFR 195.3. If PHMSA adopts a revised edition of\na referenced standard such as API, NACE International (NACE) or ASME standards into 49 CFR Part 195, the\nreferenced requirements of those revised standards are automatically incorporated into these special permit\nconditions unless noted otherwise, except as noted in Footnote 3 above.\nSpecial Permit: PHMSA-2016- 0072 - Magellan Midstream Partners, L.P. Page 3 of22\n\n<<<PAGE 6>>>\n\nc. Continuous monitoring of the special permit tank levels through the supervisory\ncontrol and data acquisition (SCADA) system; and\nd. Semi-annual, not to exceed 7 lh months, static tank trending for 12 continuous hours\nto verify the integrity of the special permit tanks. Magellan must isolate the special\npermit tanks from inbound or outbound products movements. The special permit\ntank level must be at least half full . Once isolated, the breakout storage tank must sit\nidle for a minimum of 12 continuous hours. During the static 12 hours, the special\npermit tank product level must be reviewed for product level discrepancies.\n3. Re-evaluation Inspection Intervals: Magellan must develop procedures and conduct\ntransitional staged internal inspections of the special permit tanks and must readjust\ninspection schedules of future special permit tank inspections as follows:\na. Inspection schedules of future special permit tank inspections must be based upon\npast inspection findings at a special permit tank site location or similar vintage\nconstruction types at other tank locations in this proposed special permit;\nb. Re-evaluation intervals must be shortened when special permit tank inspection\nfindings demonstrate inspection intervals were not sufficiently conservative to\nmaintain established minimum safe floor and wall thicknesses, and material corrosion\nrates;\nc. Transitional staged internal special permit tank inspection intervals must be modified\nif a breakout storage tank of similar service indicates a more conservative internal\ninspection interval should apply; and\nd. Special permit tanks of similar service must be identified by having been constructed\nduring, or within six (6) months of, the same year, under the same conditions, with\nsimilar foundations and store similar products.\nSpecial Permit: PHMSA-2016- 0072 - Magellan Midstream Partners, L.P. Annual Report to PHMSA: Annually,\n5 after issuance of this special permit, Magellan must\nsubmit an annual special permit tank integrity report6 to the PHMSA Central, Eastern,\nSouthwest and Western Region Directors with copies to the Deputy Associate Administrator,\nPHMSA Field Operations; Deputy Associate Administrator, PHMSA Policy and Programs;\nDirector, PHMSA Engineering and Research Division; and Director, PHMSA Standards and\nRulemaking Division.\n7 The annual integrity report must summarize for the special permit\ntanks the following and any other significant integrity threats as follows :\na. Any leakage of special permit tanks including location, leakage amount, repairs\ntaken, and impact of any other tanks inspection schedule or integrity;\nb. Any inspection findings that caused a readjustment of inspection schedules and the\nspecial permit tanks involved in the reschedule of inspection interval;\nc. Any secondary containment integrity issues found or remediated that would have\nimpacted containment in the case of a leak or failure of the special permit tank;\nd. Any leaks or failures found through the continuous monitoring of tank levels through\nthe SCAD A system (Condition 2.c) or the semi-annual static tank trending for 12\ncontinuous hours (Condition 2.d); and\ne. Identification of special permit tanks inspected during the past year and planned\ninspections for the next two (2) years.\nTank Integrity Program: Under the proposed special permit, Magellan must continue use\nof its existing documented Tank Integrity Program (Magellan procedure 7.1 0-ADM-001 Tank\n5 Annual reports must be received by PHMSA by the last day of the month in which the special permit is dated.\nFor example, the annual report for a special permit dated January 2018, must be received by PHMSA no later than\nJanuary 31 , each year beginning in 2019.\n6 Magellan must submit a copy of each Magellan annual pipeline integrity report on the PHMSA docket, PHMSA-\n20 16-0072, at regulations.gov.\n7 Magellan must also send a copy to the PHMSA Director of State Programs and the appropriate state authorities of\nthe states that have interstate or intrastate agent agreements with PHMSA in states where the breakout storage\ntanks are located.\nSpecial Permit: PHMSA-2016- 0072 - Magellan Midstream Partners, L.P. Integrity Program, revision date 01 /01118)8 during the transitional staged internal special\npermit tank inspection period (Condition 1 ).\nCertification: A Magellan senior executive officer, vice president or higher must certify in\nwriting the following:\na. Magellan has developed a written manual of operating and maintenance (O&M)\nprocedures required by 49 CFR 195.402 and 195.432, and all requirements ofthis\nspecial permit for the special permit tanks; and\nb. Magellan has implemented all special permit conditions, 49 CFR 195.402 and\n195.432, as required by this specia\\ permit for the special permit tanks.\nMagellan must send the certifications required in Condition 6.a and 6.b with completion\ndate, compliance documentation summary, and the required senior executive signature and\ndate of signature to the PHMSA Associate Administrator for Pipeline Safety with copies to\nthe Deputy Associate Administrator, PHMSA Field Operations; Deputy Associate\nAdministrator, PHMSA Policy and Programs; PHMSA Central, Eastern, Southwest, and\nWestern Region Directors; Director, PHMSA Standards and Rulemaking Division; Director,\nPHMSA Engineering and Research Division9\n; and to the Federal Register Docket (PHMSA-\n2016-0072) at www.Regulations.gov within one (1) year ofthe effective date ofthis special\npermit.\nIII. Limitations:\nPHMSA issues this special permit subject to the following limitations:\n1) PHMSA has the sole authority to make all determinations on whether Magellan has complied\nwith the specified conditions of this special permit.\n8 Any updates to Magellan procedure 7.10-ADM-001 Tank Integrity Program, revision dated 01 /01/18, that affect\nthe inspections, remediation and monitoring of the special permit tanks must be submitted by Magellan to\nPHMSA 's Deputy Associate Administrator, PHMSA Field Operations, for review. Magellan must receive a \"no\nobjection\" letter from PHMSA prior to any updated procedure implementation on the special permit tanks.\n9 Magellan must also send a copy to the PHMSA Director of State Programs and the appropriate state authorities of\nthe states that have interstate or intrastate agent agreements with PHMSA in states where the breakout storage\ntanks are located.\nSpecial Permit: PHMSA-2016 - 0072- Magellan Midstream Partners, L.P. Page 6 of22\n\n<<<PAGE 9>>>\n\n2) Failure to submit the certifications required by Condition 6 within the time frames specified\nmay result in revocation of this special permit.\n3) PHMSA may revoke, suspend, or modify this special permit based on any finding listed in 49\nCFR 190.341 (h)(l) and require Magellan to comply with the regulatory requirements in 49\nCFR 195.432 and an amended Condition !-Internal Inspection Schedule. As provided in 49\nU.S.C. Chapter 601 and 49 CFR Part 190, PHMSA may also issue an enforcement action for\nfailure to comply with this special permit. Any work plans and associated schedules will be\nautomatically incorporated into this special permit and are enforceable in the same manner.\n4) Should PHMSA revoke, suspend, or modify this special permit based on any finding listed in\n49 CFR 190.341 (h)(l ), PHMSA will notify Magellan in writing of the proposed action and\nprovide Magellan an opportunity to show cause why the action should not be taken. In\naccordance with 49 CFR 190.341 (h)(2)(i), Magellan may provide a written response within\n30 days of the notice showing why the proposed action should not be taken. However, if\nnecessary to avoid the risk of significant harm to persons, property, or the environment,\nPHMSA will declare the proposed action (revocation, suspension, or modification)\nimmediately effective, in accordance with 49 CFR 190.341 (h)(3).\n5) The terms and conditions of any corrective action order, compliance order, or other order\napplicable to a pipeline facility covered by this special permit will take precedence over the\nterms ofthis special permit in accordance with 49 CFR 190.341(h)(4).\n6) Magellan may seek reconsideration of a decision made pursuant to 49 CFR 190.341 (h) by\nsubmitting a petition to the Associate Administrator of Pipeline Safety, in accordance with 49\nCFR 190.341 (i). The Associate Administrator's decision made pursuant to 49 CFR\n190.341 (i) constitutes final administrative action. All final administrative actions are subject\nto juridical review under 49 U.S.C. 60119.\n7) If Magellan sells, merges, transfers, or otherwise disposes of the assets known as the special\npermit tanks, Magellan must provide PHMSA with written notice of the change within 30\ndays of the consummation date. In the event of such transfer, PHMSA reserves the right to\nrevoke, suspend, or modify the special permit if the transfer constitutes a material change in\nSpecial Permit: PHMSA-2016- 0072 - Magellan Midstream Partners, L.P.
