Dear Mr. Pearson:
On June 7, 2016, Magellan Midstream Partners, L.P. (Magellan) wrote to the Pipeline and
Hazardous Materials Safety Administration (PHMSA) requesting a special permit to waive
compliance with the pipeline safety regulations in 49 Code of Federal Regulations (CFR)
195.432 that require internal inspection intervals for in-service breakout tanks. Magellan 's
special permit request asks PHMSA to allow extended inspection intervals of 49 CFR 195.432
for Magellan ' s existing atmospheric aboveground breakout storage tanks (breakout storage tanks
or tanks).
PHMSA is granting this special permit (enclosed) to Magellan to allow extended inspection
intervals for Magellan' s existing breakout storage tanks as listed in Appendices A and B of the
special permit. This special permit provides relief from the Federal pipeline safety regulations
for Magellan 's existing breakout storage tanks, and requires Magellan to comply with certain
conditions and limitations designed to maintain pipeline safety where the tanks inspection
intervals have been extended.
The Magellan existing atmospheric aboveground breakout storage tanks and associated facilities
include 493 breakout storage tanks at 81locations in 14 states. The breakout storage tank
facilities are in industrial properties and consist of storage tanks, buildings, pump stations,
valves, facility pipe, roads, and other aboveground appurtenances. PHMSA grants this special
permit based on the permit conditions and the findings set forth in the "Analysis and Findings"
and "Final Environmental Assessment and Finding ofNo Significant Impact" documents, which
can be read in their entirety in Docket No. PHMSA-2016-0072 at www.Regulations.gov.

Grant of Special Permit:
By this order, subject to the terms and conditions set forth below, the Pipeline and Hazardous
Materials Safety Administration (PHMSA) Office of Pipeline Safety (OPS)1 grants a special
permit (PHMSA-2016-0072) to Magellan Midstream Partners, L.P. and its subsidiaries
(collectively "Magellan"f for extending the internal inspection schedule requirements in 49
Code ofFederal Regulations (CFR) 195.432 for Magellan' s existing atmospheric above ground
breakout storage tanks (breakout storage tanks or tanks). This special permit requires Magellan
to implement inspection intervals based on the evaluation of an established minimum safe floor
thickness, previous inspection results, corrosion rates, and defined likelihood and consequence
factors for existing atmospheric above ground breakout storage tanks, as described in this special
permit.

The Magellan above ground breakout storage tanks and associated facilities are at 81 locations in
14 states. These facilities are industrial properties consisting of storage tanks, buildings, pump
stations, valves, facility pipe, roads, and other above ground appurtenances.
Based on the determination in the Special Permit Analysis and Findings (available in the docket)
that this special permit, with conditions, will maintain pipeline safety, PHMSA OPS hereby
grants special permit PHMSA-2016-0072 as follows:
I. Special Permit Tanks:
493 tanks located in the States of Colorado, Connecticut, Illinois, Iowa, Kansas, Minnesota,
Missouri, Nebraska, North Dakota, Oklahoma, South Dakota, Texas, Wisconsin, and
Wyoming
On the condition that Magellan complies with the terms and conditions set forth below, this
special permit waives compliance from 49 CFR 195.432 for the inspection intervals of 493
existing atmospheric above ground breakout storage tank as described below and in Appendix A
-Magellan Breakout Storage Tanks: Location- State, Facility Name, County, and Number of
Tanks and Appendix B- Secondary Dike Containment of this special permit.
• Special permit tanks- are defined as any of the 493-existing atmospheric above ground
breakout storage tank described in Appendix A of this special permit.
PHMSA hereby grants this special permit for the Magellan special permit tanks based on the
findings set forth in the "Special Permit Analysis and Findings" and the "Final Environmental
Assessment and Findings of No Significant Impact" documents, which both can be read in their
entirety in Docket No. PHMSA-2016-0072 in the Federal Docket Management System (FDMS)
located on the internet at www.Regulations.gov.
II. Conditions:
PHMSA OPS grants this special permit for the special permit tanks subject to implementation of
the following conditions:

1. Internal Inspection Schedule: For the atmospheric above ground breakout storage tanks
(special permit tanks), Magellan must conduct a transitional staged internal inspection
schedule as follows:
a. Special Permit Tanks Last Inspected Before 1995: Inspect within 30 years of the
previous internal inspection date (25 tanks remain to be inspected as of May 20 17).
b. Special Permit Tanks Last Inspected Between 1995 and 2009: Inspect within 28
years of the previous internal inspection date (333 tanks remain to be inspected as of
May 2017).
c. Special Permit Tanks Last Inspected Between 2010 and 2013: Inspect within 25
years of the previous internal inspection date ( 13 5 tanks remain to be inspected as of
May 2017).
2. Special Permit Tank Inspections and Monitoring: Magellan must develop procedures,
conduct, document, and maintain:
a. Internal inspections of the described existing special permit tanks that are consistent
with the special permit and as required by 49 CFR 195.432;3'4
b. Visual inspections of the special permit tanks and their secondary containment dikes
are required once per manned shift and at least weekly for unmanned locations.
Magellan personnel must inspect the tank farm (including tanks and containment) for
the integrity of the containment dikes or secondary containment, evidence of product
releases, trash and debris, uncontrolled erosion, unusual sounds from operating
equipment, damage, vibration, misalignment, and security;
3 If PHMSA adopts a revised edition of API Standard 653 other than the 3rd edition into 49 CFR Part 195, Magellan
must notify PHMSA within 60 days of the effective date of the adopted revised standard regarding the option to
continue compliance under this special permit with the existing API Standard 653 3rd edition or comply with the
updated edition under 49 CFR Section 195.3. However, if the revised adopted edition of API Standard 653
continues to exclude alternate inspection intervals, the conditions of the special permit will remain in effect for the
determination of inspection intervals.
4 Industry standards "incorporated by reference" are listed in 49 CFR 195.3. If PHMSA adopts a revised edition of
a referenced standard such as API, NACE International (NACE) or ASME standards into 49 CFR Part 195, the
referenced requirements of those revised standards are automatically incorporated into these special permit
conditions unless noted otherwise, except as noted in Footnote 3 above.

c. Continuous monitoring of the special permit tank levels through the supervisory
control and data acquisition (SCADA) system; and
d. Semi-annual, not to exceed 7 lh months, static tank trending for 12 continuous hours
to verify the integrity of the special permit tanks. Magellan must isolate the special
permit tanks from inbound or outbound products movements. The special permit
tank level must be at least half full . Once isolated, the breakout storage tank must sit
idle for a minimum of 12 continuous hours. During the static 12 hours, the special
permit tank product level must be reviewed for product level discrepancies.
3. Re-evaluation Inspection Intervals: Magellan must develop procedures and conduct
transitional staged internal inspections of the special permit tanks and must readjust
inspection schedules of future special permit tank inspections as follows:
a. Inspection schedules of future special permit tank inspections must be based upon
past inspection findings at a special permit tank site location or similar vintage
construction types at other tank locations in this proposed special permit;
b. Re-evaluation intervals must be shortened when special permit tank inspection
findings demonstrate inspection intervals were not sufficiently conservative to
maintain established minimum safe floor and wall thicknesses, and material corrosion
rates;
c. Transitional staged internal special permit tank inspection intervals must be modified
if a breakout storage tank of similar service indicates a more conservative internal
inspection interval should apply; and
d. Special permit tanks of similar service must be identified by having been constructed
during, or within six (6) months of, the same year, under the same conditions, with
similar foundations and store similar products.

4. 5. Annual Report to PHMSA: Annually,
5 after issuance of this special permit, Magellan must
submit an annual special permit tank integrity report6 to the PHMSA Central, Eastern,
Southwest and Western Region Directors with copies to the Deputy Associate Administrator,
PHMSA Field Operations; Deputy Associate Administrator, PHMSA Policy and Programs;
Director, PHMSA Engineering and Research Division; and Director, PHMSA Standards and
Rulemaking Division.
7 The annual integrity report must summarize for the special permit
tanks the following and any other significant integrity threats as follows :
a. Any leakage of special permit tanks including location, leakage amount, repairs
taken, and impact of any other tanks inspection schedule or integrity;
b. Any inspection findings that caused a readjustment of inspection schedules and the
special permit tanks involved in the reschedule of inspection interval;
c. Any secondary containment integrity issues found or remediated that would have
impacted containment in the case of a leak or failure of the special permit tank;
d. Any leaks or failures found through the continuous monitoring of tank levels through
the SCAD A system (Condition 2.c) or the semi-annual static tank trending for 12
continuous hours (Condition 2.d); and
e. Identification of special permit tanks inspected during the past year and planned
inspections for the next two (2) years.
Tank Integrity Program: Under the proposed special permit, Magellan must continue use
of its existing documented Tank Integrity Program (Magellan procedure 7.1 0-ADM-001 Tank
5 Annual reports must be received by PHMSA by the last day of the month in which the special permit is dated.
For example, the annual report for a special permit dated January 2018, must be received by PHMSA no later than
January 31 , each year beginning in 2019.
6 Magellan must submit a copy of each Magellan annual pipeline integrity report on the PHMSA docket, PHMSA-
20 16-0072, at regulations.gov.
7 Magellan must also send a copy to the PHMSA Director of State Programs and the appropriate state authorities of
the states that have interstate or intrastate agent agreements with PHMSA in states where the breakout storage
tanks are located.

6. Integrity Program, revision date 01 /01118)8 during the transitional staged internal special
permit tank inspection period (Condition 1 ).
Certification: A Magellan senior executive officer, vice president or higher must certify in
writing the following:
a. Magellan has developed a written manual of operating and maintenance (O&M)
procedures required by 49 CFR 195.402 and 195.432, and all requirements ofthis
special permit for the special permit tanks; and
b. Magellan has implemented all special permit conditions, 49 CFR 195.402 and
195.432, as required by this specia\ permit for the special permit tanks.
Magellan must send the certifications required in Condition 6.a and 6.b with completion
date, compliance documentation summary, and the required senior executive signature and
date of signature to the PHMSA Associate Administrator for Pipeline Safety with copies to
the Deputy Associate Administrator, PHMSA Field Operations; Deputy Associate
Administrator, PHMSA Policy and Programs; PHMSA Central, Eastern, Southwest, and
Western Region Directors; Director, PHMSA Standards and Rulemaking Division; Director,
PHMSA Engineering and Research Division9
; and to the Federal Register Docket (PHMSA-
2016-0072) at www.Regulations.gov within one (1) year ofthe effective date ofthis special
permit.
III. Limitations:
PHMSA issues this special permit subject to the following limitations:
1) PHMSA has the sole authority to make all determinations on whether Magellan has complied
with the specified conditions of this special permit.
8 Any updates to Magellan procedure 7.10-ADM-001 Tank Integrity Program, revision dated 01 /01/18, that affect
the inspections, remediation and monitoring of the special permit tanks must be submitted by Magellan to
PHMSA 's Deputy Associate Administrator, PHMSA Field Operations, for review. Magellan must receive a "no
objection" letter from PHMSA prior to any updated procedure implementation on the special permit tanks.
9 Magellan must also send a copy to the PHMSA Director of State Programs and the appropriate state authorities of
the states that have interstate or intrastate agent agreements with PHMSA in states where the breakout storage
tanks are located.

2) Failure to submit the certifications required by Condition 6 within the time frames specified
may result in revocation of this special permit.
3) PHMSA may revoke, suspend, or modify this special permit based on any finding listed in 49
CFR 190.341 (h)(l) and require Magellan to comply with the regulatory requirements in 49
CFR 195.432 and an amended Condition !-Internal Inspection Schedule. As provided in 49
U.S.C. Chapter 601 and 49 CFR Part 190, PHMSA may also issue an enforcement action for
failure to comply with this special permit. Any work plans and associated schedules will be
automatically incorporated into this special permit and are enforceable in the same manner.
4) Should PHMSA revoke, suspend, or modify this special permit based on any finding listed in
49 CFR 190.341 (h)(l ), PHMSA will notify Magellan in writing of the proposed action and
provide Magellan an opportunity to show cause why the action should not be taken. In
accordance with 49 CFR 190.341 (h)(2)(i), Magellan may provide a written response within
30 days of the notice showing why the proposed action should not be taken. However, if
necessary to avoid the risk of significant harm to persons, property, or the environment,
PHMSA will declare the proposed action (revocation, suspension, or modification)
immediately effective, in accordance with 49 CFR 190.341 (h)(3).
5) The terms and conditions of any corrective action order, compliance order, or other order
applicable to a pipeline facility covered by this special permit will take precedence over the
terms ofthis special permit in accordance with 49 CFR 190.341(h)(4).
6) Magellan may seek reconsideration of a decision made pursuant to 49 CFR 190.341 (h) by
submitting a petition to the Associate Administrator of Pipeline Safety, in accordance with 49
CFR 190.341 (i). The Associate Administrator's decision made pursuant to 49 CFR
190.341 (i) constitutes final administrative action. All final administrative actions are subject
to juridical review under 49 U.S.C. 60119.
7) If Magellan sells, merges, transfers, or otherwise disposes of the assets known as the special
permit tanks, Magellan must provide PHMSA with written notice of the change within 30
days of the consummation date. In the event of such transfer, PHMSA reserves the right to
revoke, suspend, or modify the special permit if the transfer constitutes a material change in

conditions or circumstances pursuant to 49 CFR 190.341 (h)(l )(ii) or any other circumstances
listed under 49 CFR 190.341(h)(l) .

8) PHMSA grants this special permit to a term of no more than 20 years from the issuance date.
