002MINIMUM SAFETY STANDARDS FOR PIPELINES.#
002.01MINIMUM SAFETY STANDARDS. Unless otherwise specified by the Commission, pipeline carriers shall use the applicable provisions of the procedures established by the United States Department of Transportation as codified at 49 CFR 192. These incorporated materials are available for inspection at the offices of the State Fire Marshal or the Nebraska Secretary of State, Division of Rules and Regulations.#
002.02SCOPE. These provisions shall apply to all intrastate pipeline carriers operating within the state.#
002.03FACILITIES, INSPECTION AND REPAIRS. All Facilities shall be cleaned when necessary and inspected at such intervals as the Commission shall determine. Any Facilities known to be defective so as to endanger life or property shall be promptly repaired, permanently disconnected or isolated until repairs can be made.#
002.04WAIVING OF RULES. The rules may be modified or waived by the Commission wherever shown to be impractical or where the advantage of uniformity with existing construction is greater than construction in compliance with the rules providing that the existing construction is equivalently safe to the existing rules.#
002.05WAIVER OF TEMPORARY INSTALLATIONS. These rules may be waived by the Commission in cases of temporary installations for a reasonable length of time provided that such construction is under competent supervision and has been made reasonably safe.#
