Fisette, Vice President International Matex Tank Terminals (IMTT-Pipeline) 250 East 22nd St. Bayonne, NJ 07002 CPF 1-2012-5016 Dear Mr. Fisette: On August 16-19, 2010, a representative the New York State Department of Public Service (NYSDPS) acting as agent of the Pipeline and Hazardous Materials Safety Administration (PHMSA) pursuant to Chapter 601 of 49 United States Code inspected your pipeline facilities in Staten Island, NY. As a result of this inspection, IMTT-Pipeline (IMTT) was issued a Notice of Probable Violation and Proposed Civil Penalty (Notice) on August 10, 2012 in the above- referenced case. This Notice alleged that IMTT was in violation of §192.266(a) by not having a complete record related to the construction records required by §192.266(a); and in violation of §192.266(b) by not having a complete record related to the construction records required by §192.266(b). IMTT responded to this Notice by letter, dated October 5, 2012. IMTT provided additional information and documentation to show it had complied with the regulation. Upon further review, we determined that at the time of the inspection a violation did not exist. This letter is to inform you that PHMSA hereby withdraws the Notice and that the case is now closed.
