(Texas Eastern) was issued a Notice of Probable Violation (Notice) and Proposed Civil Penalty for the case number referenced above. This Notice cited Texas Eastern for a recordkeeping violation under 49 CFR § 192.947(c). Based on our review of the documentation provided by Texas Eastern on April 10 and May 23, 2019, it has been determined that the records provided demonstrate that the written baseline assessment plan and associated baseline assessment records for pipeline segments located in high consequence areas in Ohio were maintained. This letter is to inform you that PHMSA hereby withdraws the Notice and that the case is now closed.
