42021001NOPV_Final Order_11242021_(20-172501)_text.pdf, page 2U.S. DEPARTMENT OF TRANSPORTATION PIPELINE AND HAZARDOUS MATERIALS SAFETY ADMINISTRATION OFFICE OF PIPELINE SAFETY WASHINGTON, D.C. 20590 ____________________________________________ In the Matter of ) ) ) Enable Gas Transmission, LLC, ) a subsidiary of Enable Midstream Partners, LP, ) Respondent. ) ____________________________________________) ) CPF No. 4-2021-001-NOPV FINAL ORDER On October 4, 2021, pursuant to 49 C.F.R. § 190.207, the Director, Southwest Region, Office of Pipeline Safety (OPS), issued a Notice of Probable Violation (Notice) to Enable Gas Transmission, LLC (Respondent). The Notice proposed finding that Respondent had violated the pipeline safety regulations in 49 C.F.R. Part 192. The Notice also proposed certain measures to correct the violations. Enable Midstream Partners, LP, on behalf of Respondent, replied to the Notice and did not contest the allegations of violation or corrective measures. Based upon a review of all of the evidence, pursuant to § 190.213, I find Respondent violated the pipeline safety regulations listed below, as more fully described in the enclosed Notice, which is incorporated by reference: 49 C.F.R. § 192.481(c) (Item 1) ─ Respondent failed to provide protection against atmospheric corrosion found during inspections as required by § 192.479. 49 C.F.R. § 192.739(a) (Item 2) ─ Respondent failed to inspect and test each pressure limiting station, relief device (except rupture discs), and pressure regulating station and its equipment at intervals not exceeding 15 months, but at least once each calendar year. 49 C.F.R. § 192.619(a) (Item 3) ─ Respondent failed to operate a segment of steel or plastic pipeline at a pressure that did not exceed a maximum allowable operating pressure determined under paragraph (c), (d), or (e) of this section, or the lowest of the alternatives presented by subparts (1) through (4) of § 192.619(a). These findings of violation will be considered prior offenses in any subsequent enforcement action taken against Respondent.#
42021001NOPV_Final Order_11242021_(20-172501)_text.pdf, page 3CPF No. 4-2021-001-NOPV Page 2 COMPLIANCE ACTIONS Pursuant to 49 U.S.C. § 60118(b) and 49 C.F.R. § 190.217, Respondent is ordered to take the actions proposed in the enclosed Notice to correct the violations. The Director may grant an extension of time to comply with any of the required items upon a written request timely submitted by the Respondent and demonstrating good cause for an extension. Upon completion of ordered actions, Respondent may request that the Director close the case. Failure to comply with this Order may result in the assessment of civil penalties under 49 C.F.R. § 190.223 or in referral to the Attorney General for appropriate relief in a district court of the United States. 42021001NOPV_Closure Letter_12092022_(20-172501)_text.pdf, page 1Official PDFVIA ELECTRONIC MAIL December 9, 2022 Mr. Greg McIlwain Executive Vice President, Operations Energy Transfer Company 1300 Main Street Houston, Texas 77002 CPF 4-2021-001-NOPV Dear Mr. McIlwain: On November 24, 2021, a representative from the Pipeline and Hazardous Materials Safety Administration (PHMSA), pursuant to chapter 601 of 49 United States Code, conducted an on site pipeline safety inspection of Enable Gas Transmission, LLC’s (Enable) operations, maintenance, and integrity management records for its pipeline system in Louisiana, Texas, and Arkansas. As a result of the inspection, Enable was issued a Final Order (Order) in the above-referenced case. This Order included a Compliance Order. Based on PHMSA’s review of the documentation provided by Enable, it has been determined that Enable has complied with the terms of the Final Order. Accordingly, this case is now closed, and no further action is contemplated with respect to the matters involved in this case. Thank you for your cooperation in this matter.
