On the basis of the inspection, PHMSA has identified the apparent inadequacies found within The City of Victorville's plans or procedures, as described below: $191. 5 Telephonic notice of certain incidents. (a) At the earliest practicable moment following discovery, each operator shall give notice in accordance with paragraph (b) of this section of each incident as defined in $191. 3. (b) Each notice required by paragraph (a) of this section shall be made by telephone to 800-424-8802(in %ashington, DC, 267-2675) and shall include the following information: (1) Names of operator and person making report and their telephone numbers. (2) The location of the incident. (3) The time of the incident. (4) The number of fatalities and personal injuries, if any. (5) All other significant facts that are known by the operator that are relevant to the cause of the incident or extent of the damages.#

Specifically, it did not have procedures for "Telephonic Notices of Certain Incidents. " 2. f191. 9 Distribution system: Incident report. (a) Except as provided in paragraph (c) of this section, each operator of a distribution pipeline system shall submit Department of Transportation Form RSPA F 7100. 1 as soon a practicable but not more than 30 days after detection of an incident required to be reported under f191. 5. (b) %'hen additional relevant information is obtained after the report is submitted under paragraph (a) of this section, the operator shall make supplementary reports as deemed necessary with a clear reference by date and subject to the original report. The City of Victorville's O&M manual did not have procedures for submitting written "Incident Reports. " 3. f192. 513 Test requirements for plastic pipelines. (a) Each segment of a plastic pipeline must be tested in accordance with this section. (b) The test procedure must insure discovery of all potentially hazardous leaks in the segment being tested. (c) The test pressure must be at least 150 percent of the maximum operating pressure or 50 p. s. i. (345 kPa) gage, whichever is greater. However, the maximum test pressure may not be more than three times the pressure determined under f192. 121, at a temperature not less than the pipe temperature during the test. The City of Victorville's O&M manuals specifies the test pressure to be no less than 30 psi for 10 minutes. The test pressure for plastic pipelines needs to be 150% of MAOP or 50 psi, whichever is greater. Res onse to this Notice This Notice is provided pursuant to 49 U. S. C. $ 60108(a) and 49 C. F. R. $ 190. 237. Enclosed as part of this Notice is a document entitled Response Options for Pipeline Operators in Compliance Proceedings. Please refer to this document and note the response options. Be advised that all material you submit in response to this enforcement action is subject to being made publicly available. If you believe that any portion of your responsive material qualifies for confidential treatment under 5 U. S. C. 552(b), along with the complete original document you must provide a second copy of the document with the portions you believe qualify for confidential treatment redacted and an explanation of why you believe the redacted information qualifies for confidential treatment under 5 U. S. C. 552(b). If you do not respond within 30 days of receipt of this Notice, this constitutes a waiver of your right to contest the allegations in this Notice and authorizes the Associate Administrator for Pipeline Safety to find facts as alleged in this Notice without further notice to you and to issue a Final Order.#

F. R. ) 190. 237). If you are not contesting this Notice, we propose that you submit your amended procedures to my office within 30 days of receipt of this Notice. This period may be extended by written request for good cause, Once the inadequacies identified herein have been addressed in your amended procedures, this enforcement action will be closed.
