The Notice proposed finding that Respondent had violated the pipeline safety regulations in 49 C.F.R. Part 195. The Notice also proposed certain measures to correct the violations. Respondent did not contest the allegations of violation or corrective measures. Based upon a review of all of the evidence, pursuant to § 190.213, I find Respondent violated the pipeline safety regulations listed below, as more fully described in the enclosed Notice, which is incorporated by reference: 49 C.F.R. § 195.402(a) (Item 1) ─ Respondent failed to follow its written procedures when conducting normal operations and maintenance activities; 49 C.F.R. § 195.583(a) (Item 2) ─ Respondent failed to inspect its pipeline that is exposed to the atmosphere for evidence of atmospheric corrosion; and 49 C.F.R. § 195.581(a) (Item 3) ─ Respondent failed to provide protection against atmospheric corrosion. These findings of violation will be considered prior offenses in any subsequent enforcement action taken against Respondent. Compliance Actions Pursuant to 49 U.S.C. § 60118(b) and 49 C.F.R. § 190.217, Respondent is ordered to take the actions proposed in the enclosed Notice to correct the violations. The Director may grant an extension of time to comply with any of the required items upon a written request timely submitted by the Respondent and demonstrating good cause for an extension. This Order included a Compliance Order. On August 29, 2024, PHMSA received P66’s response to the Final Order. Based on our review of the documentation you provided, it has been determined that you have complied with the terms of this Order. Regarding Items 1 and 2, the Compliance Order required Phillips 66 to follow its procedure to inspect each portion of pipe exposed to the atmosphere for evidence of atmospheric corrosion, document the findings, and remediate any deficiencies. According to the records submitted, P66 has amended its procedures and facility locations associated with this PHMSA inspection were re-inspected for evidence of atmospheric corrosion and deficiencies have been remediated. Accordingly, Items 1 and 2 have been completed. Regarding Item 3, the Compliance Order required P66 to clean and coat each unprotected portion of pipeline. According to the records submitted, P66 has cleaned and recoated pipeline facilities requiring remediation. Accordingly, Item 3 has been completed. This letter is to inform you no further action is necessary, this case is now closed. Thank you for your cooperation in this matter.#
