Fireworks are an explosive Class 1 hazardous material (hazmat) Division 1.1G, 1.3G, 1.4G, and Division 1.4S, and their safe transportation is regulated by the Hazardous Materials Regulations (HMR) (see 49 Code of Federal Regulations (CFR) Parts 171-180). YOU MUST COMPLY! Fireworks Shipments MUST: • Be in UN-certified packaging that is properly marked and labeled. Be accompanied by a Shipping Paper that contains the required information. Be accompanied by emergency response information. Shippers and Carriers MUST: • Ensure that all hazmat employees, including drivers, are properly trained. Hold a current USDOT Hazardous Materials Certificate of Registration for fireworks in placarded quantities. Develop/implement security plans that, at a minimum, include a risk assesssment, address personnel and en route security, and unauthorized access. Possess a valid Hazardous Materials Safety Permit (HMSP) (carriers only) when transporting 55 lbs., or more, of 1.1G and 1.3G. Transport Vehicles MUST: • Be operated by a properly licensed driver with a CDL and hazmat endorsement for all placardable quantities. Be properly placarded on all four sides. Have all contents blocked and braced to prevent shifting. Display company name and DOT number on doors of the motorized unit. Persons found to be in violation of the HMR may be subject to significant civil penalties, criminal fines, and imprisonment. Maximum penalties can range up to $175,000 , per violation, for a civil penalty; and $250,000 and 10 years in prison for a criminal penalty!
