No.: 05-0097 President Georgia gulf Sulfur Corporation P. O. Box 1165 Valdosta, Georgia 31603-1165 Dear Mr. Jennett: This responds to your letter dated April 1, 2005, regarding the domestic entry "Sulfur, 9, NA1350, III" in the §172.101 Hazardous Materials Table (§172.101 HMT) under the Hazardous Materials Regulations (HMR; 49 CFR Parts 171-180). On December 20, 2004, a final rule [69 FR 76044; Docket HM-215G] was published in the Federal Register entitled "Hazardous Materials: Harmonization with the United Nations Recommendations, International Maritime Dangerous Goods Code, and the International Civil Aviation Organization's Technical Instructions", incorporating various amendments to the HMR to maintain alignment with the international standards. For the domestic entry "Sulfur, 9, NA1350, III", an inadvertent error indicated Special Provision "10" instead of "30" in Column 7 of the §172.101 HMT. A correction document under Docket HM-215G will be issued to correct this inadvertent error. Compliance with the amendments adopted in this final rule is not required until January 1, 2006. I hope this satisfies your inquiry. If we can be of further assistance, please contact us. / Chice Standards Die aprians Office of Hazardous Materials Standards 1721102 050097#

Washington, DC 20590-0001 Dear Sir I have just received the March 2005 publication of the 172.101 Hazardous Materials Table and note that Domestic Sulfur NA1350 lists Special Provisions (172.102) as 10, IB8, IP2. I have called your assistance line and received the information that the 10 is a misprint, it should be 30, IB8, IP2 and that we can use the Sept 2003 pages until Jan 1, 2006. Internally, this is satisfactory however, we need a short note from your office to prove our packaging is correct to our transportation companies and to our customers. Further, if the intent is to eliminate the paragraph 30 special provision for domestic shipments of solid sulfur on Jan 1, 2006, we would like to know as soon as possible so that we can use up our old stocks of packaging materials and purchase the correct packages. Please give me a call if you have any questions. (229) 244-0000 Sincerely, guys amnes Jerry J. Jennett President: JJJ/nda Office: P. O.
