No. 99-0095 3225 West Gibson Lane Phoenix, Arizona 85009 Dear Mr. Kloppel: This responds to your letter addressed to the Environmental Protection Agency and postmarked February 24, 1999, concerning requirements for transporting explosive material in the continental United States. Your letter was referred to this office for response. explosives and explosive material are included in the Federal regulations applicable to the transportation of Hazardous Materials Regulations (HMR; 49 CFR Parts 171-180): The HMR set forth procedures that you must follow if you ship or transport a hazardous material in: the course of your business. The HMR explain how to classify and package hazardous material and how the package must be marked and labeled. The HMR also tell how to complete the shipping papers and emergency response information that must accompany a hazardous material shipment... In addition, the HMR tell whether the vehicle in which a hazardous materials shipment is being transported must be placarded and the specific placards that must be used. Finally, the HMR explain training requirements for persons who transport hazardous materials or prepare hazardous materials for shipment. You do not need a federal license to transport explosives in the continental United States. However, you may not offer for transportation or transport an explosive unless it has been tested, classed, and approved by the Associate Administrator for Hazardous Materials Safety. Regulations governing definitions, classification, and packaging of explosives (Class 1 materials) are in Subpart D of Part 173 of the HMR.
