Compliance letters were not sent out in CY2020 because Colorado was in the middle of a rulemaking that would give the program more authority to enforce over the 22 MM and LPG systems. The standard enforcement process didn't adequately apply to operators of Master Meter and LPG systems. The rulemaking was approved by the Commission and became effective June 2021. Compliance letter were reviewed by the Attorney General's office. Eight of 17 letters did go out in December 2021 and the remainder going out in early 2022. Other inspections conducted in CY2021 did not go out within the 90-day requirement or has not been issued yet. The program has developed a strategic plan/schedule to ensure that intervals are met. The program has successfully hired 5, new, full time inspectors. Item 2: To ensure that all inspection questions are answered, the program has begun utilizing the IA all inspection types except for MMO and LPG inspections. The program hopes to add state-specific content (rules and Forms) to the IA at a future date. Item 3: To properly document future IM inspections, efforts underway under items 1 and 2 will address this deficiency. Item 4: Timely issuance of preliminary findings within the 90 day requirement. The program has developed a IT solution for record keeping and timelines associated with incident investigations. The data Management System (Highland On-Base) will maintain records and other documentation as well as when follow-up communications are needed. Items 6. Failure of the Chairman to respond to the PHMSA - State Programs Director's letter identifying deficiencies noted on the previous CY2019 program evaluation.
