Joel Tierney Pipeline Safety Program Manager Montana Public Service Commission 1701 Prospect Avenue Helena, Montana 59620-2601 Re: Docket No. PHMSA-2023-0115 Montana Public Service Commission – Docket – 2023.03.019 Dear Mr. Tierney: On October 5, 2023, pursuant to 49 United States Code (USC) § 60118(d), the Montana Public Service Commission (Commission) notified the Pipeline and Hazardous Materials Safety Administration (PHMSA) that it granted a waiver to Hiland Partner Holdings LLC (Hiland). The Commission issued the waiver (Docket – 2023.03.013) to Hiland on October 4, 2023, for the 9.15 mile Bakken to WBI Natural Gas Residue Pipeline (Bakken Residue Line), an 8-inch steel pipeline that carries natural gas in Richland County, Montana. The waiver allows Hiland to utilize the Zap-Lok technology for joining pipe in the Bakken Residue Line. The applicant requested a waiver of 49 C.F.R. §§ 192.55, 192.105, 192.109, 192.271, and 192.273 to continue operation of the pipeline and use the Zap-Lock technology. Pursuant to 49 USC § 60118(d), PHMSA does not object to issuance of this waiver by the Commission to Hiland. If you wish to discuss this or any other pipeline safety matter, please contact Mary L.
